These Terms of Service govern your use of Black Health. Please read them carefully.
These Terms of Service govern your use of blackhealth.org and all related products and services (collectively, 'Services') operated by Black Health. By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our Services.
Description of Services
Black Health provides a health information platform, a directory of Black health professionals, a newsletter, and video content. We may add, modify, or discontinue Services at any time without notice.
Account responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account at hello@blackhealth.org. You must be at least 18 years old to create an account.
Provider listings: specific terms
Providers who create a listing warrant that: all information submitted is accurate and current; they hold an active, unencumbered license to practice in the states where they represent themselves as practicing; they will update their listing promptly if their license status changes; they identify as Black or of African descent, consistent with our directory's mission.
Black Health reserves the right to refuse, remove, or suspend any listing for any reason, including but not limited to: inaccurate credentials; disciplinary action by a licensing board; reports of patient harm; failure to maintain an active license; conduct inconsistent with our community standards.
Providers are responsible for ensuring their listing complies with applicable professional advertising standards and state licensing board rules.
Payment terms
Verified and Featured listings are billed monthly in advance. All fees are in USD. Fees are non-refundable except as required by law. We reserve the right to change fees with 30 days' notice. If your payment fails, your listing may be downgraded to the free tier.
Prohibited uses
You agree not to: scrape, harvest, or systematically extract data from our Services; use our Services for any unlawful purpose; impersonate any person or entity; submit false or misleading information; interfere with the operation of our Services; attempt to gain unauthorized access to any part of our platform.
DMCA and intellectual property
If you believe content on our platform infringes your copyright, send a DMCA takedown notice to legal@blackhealth.org with: a description of the copyrighted work, the URL of the infringing material, your contact information, and a statement under penalty of perjury that you are authorized to act on behalf of the copyright owner.
Disclaimers
Our Services are provided 'as is' and 'as available' without warranty of any kind. We disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that our Services will be uninterrupted, error-free, or free of viruses or other harmful components.
Limitation of liability
To the maximum extent permitted by applicable law, Black Health's liability for any claim arising from your use of our Services is limited to the amount you paid us in the twelve months preceding the claim, or $100, whichever is greater. In no event will Black Health be liable for indirect, incidental, special, consequential, or punitive damages.
Indemnification
You agree to indemnify and hold harmless Black Health, its officers, directors, employees, and agents from any claims, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of our Services, your violation of these Terms, or your violation of any third-party rights.
Changes to Terms
We may update these Terms at any time. We will post the updated Terms with a revised effective date. Continued use of our Services after the effective date constitutes acceptance of the updated Terms.
Governing law and arbitration
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any dispute arising under these Terms will be resolved by binding arbitration under the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction. You waive any right to a jury trial or to participate in a class action.
Severability and entire agreement
If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Black Health with respect to our Services.
